Veto messages are not usually the place to seek inspiration, but they can provide a window into a Governor’s thinking. So when Gov. Jerry Brown opted to veto all of the various infrastructure-related bills on his desk last week, including SB 214 (Wolk), which was supported by the League, it is worth reviewing these messages both for what they say and don’t say.

On Thursday, League-supported SB 214 (Wolk) was passed in the Senate with a 22 – 15 vote, sending it to Gov. Jerry Brown. SB 214 makes important changes to existing Infrastructure Financing District (IFD) law and will enable IFDs to become a more helpful financing tool for a wide variety of local infrastructure.

On Aug. 1, Bond insurer Syncora Guarantee filed a lawsuit in the Sacramento County Superior Court claiming that the dissolution of California’s 400 redevelopment agencies violates contractual rights and short-changes bondholders and insurers.

AB 1484, the redevelopment trailer bill, required successor agencies to remit payments by July 12 or be subject to penalties including the withholding of sales and use tax revenues beginning today. However, due to the strict time frame it appears that the Board of Equalization (BOE) will not make adjustments until August.

Earlier this year, the California Supreme Court concluded the Legislature could not enact legislation exacting local redevelopment agency revenues in order to fund the state budget in violation of Proposition 22 (2010). Today — only six months later — the Legislature passed AB 1484, the 73-page budget “trailer bill,” containing unconstitutional sales and property tax clawback or garnishment provisions.

Today, both the Senate and Assembly passed the main budget bill, AB 1464, and six budget-related trailer bills. Technically speaking, this package allows the Legislature to meet the constitutional deadline to pass a budget by June 15, and avoid forfeiting salary pursuant to Proposition 25 (2010). The budget package is anticipated to be sent to Gov. Jerry Brown today, but his response is unclear as it does not represent a negotiated deal.

Thanks to the numerous city officials who have contacted their legislators, progress has been delayed on the development of redevelopment trailer bill language, because many Democrat legislators are now pushing in their caucuses for a redevelopment trailer bill that will work for the cities.

It has been a long strange trip for post-redevelopment legislation in the Senate: Assembly Speaker John Pérez’s (D-Los Angeles) AB 1585 has never had a hearing; Sen. Fran Pavley’s (D-Agoura Hills) thoughtful brownfield bill, SB 1335, was held in Appropriations; and Sen. Bob Dutton (R-Inland Empire) ended up voting against his SB 986 after it was jammed with hostile amendments. Meanwhile, Senate Pro Tem Darrell Steinberg’s (D-Sacramento) bills SB 1151 and 1156 were amended and moved to the Assembly.
