Governor Signs Local Government Omnibus Bill Containing Provisions to Clarify Last Year’s SB 244

Last October, Gov. Jerry Brown signed SB 244 (Wolk), which requires cities to update the land use element of their General Plan by the next revision of their housing element to plan for disadvantaged unincorporated communities, including communities outside a city's boundaries if it is in the city's sphere of influence. This year, the League was able to make a small, but important clarification with regards to this onerous requirement.

 

SB 1090, the Local Government Omnibus bill, contains a provision (Government Code section 65302.10) that clarifies the responsibilities of each city to update their General Plan  based upon available information, such as the data and analysis provided by a LAFCo. The language added by SB 1090 in 2012 eases the significant requirements added under SB 244, that local governments should not be required to undertake new studies or analysis in order to update the general plan.
