The bill moved out of the Assembly Local Government Committee on Wednesday, June 27 and now heads to the Assembly Floor.
SB 1003 amends the Ralph M. Brown Act (Brown Act) to add “past” actions to Government Code section 54960 (a). After months of negotiation by the League, amendments were added that protect cities. Those amendments do not allow a lawsuit to be filed against a local public agency concerning a past practice without adequate notice to the agency and without giving the agency an opportunity to respond to an allegation of noncompliance with the Brown Act. With these minimum protections in place, the League has now taken a neutral position.
