League Releases Third Q & A Guide on Post-Redevelopment Legal Issues - Transfer of Housing Assets

League's Post-Redevelopment Working Group Looking at Concerns with DOF's review of ROPS

The League has released the third in a series of question and answer guides to assist cities struggling with issues arising from ABx1 26, the redevelopment dissolution statute.

 

This statute, as modified by the California Supreme Court’s decision in California Redevelopment Association v. Matasantos, has generated considerable uncertainty and confusion. In response, the League’s City Attorneys’ Department formed a Post-Development Working Group of experienced city attorneys and redevelopment attorneys to help advise the League on the numerous legal issues that have arisen in the wake of redevelopment agencies being dissolved.

This working group’s third question and answer guide addresses the transfer of housing assets.
 
The Q & A can be found on the League's website. Future guides will cover: successor agency and oversight boards, labor and employment, and environmental issues.
 
Over the past week, the League has heard numerous concerns from successor agencies regarding Department of Finance (DOF) challenging ROPS submittals for including allegedly ineligible obligations. The working group will be discussing this issue today on its weekly conference call, and will consider what guidance can be provided to successor agencies in responding to DOF.
