League-Sponsored Medical Marijuana Bill Passes Assembly Public Safety Committee

 
This morning the Assembly Public Safety Committee held a special one-bill hearing to consider SB 1262 (Correa), the medical marijuana bill co-sponsored by the League and the California Police Chiefs. After a short discussion and testimony, the committee passed Sen. Lou Correa’s (D-Santa Ana) legislation on a 6-1 bipartisan vote. SB 1262 next moves to the Assembly Appropriations Committee and could be heard there as early as Friday.
 
Today’s hearing was the result of a collaborative effort between Sen. Correa and committee chair Assembly Member Tom Ammiano (D-San Francisco) to craft additional regulatory provisions related to medical marijuana regulation. Sen. Correa thanked the chair for his work on this issue, and Assembly Member Ammiano stated his desire that the bill ultimately have a successful floor vote in the Assembly. Both committee members and witnesses expressed a commitment to work on the bill as it moves forward due to their view that the bill’s regulatory framework, which enhances protection for patients, is important. SB 1262 would establish a licensing and regulatory framework for the cultivation, processing, transportation, and sale of medical marijuana in California.

The bill’s amendments continue to ensure that medical marijuana regulation will be subject to local control. In brief, no state license could be issued by the Department of Consumer Affairs’ Bureau of Medical Marijuana Regulation unless it first received evidence of compliance with local ordinances and regulations. If a local agency notifies the bureau that a dispensary is not in compliance with local laws, the dispensary’s license would be suspended within 10 days.
